My manager who recently has had her arm put in a cast wrote this on the whiteboard in the back of our restaurant.

If you want to dictate what I do during my time off, pay me. Pay me to be on call. I might be out of town, or at my doctor’s office. Or sleeping. Or high. But if you want me at your beck and call, pay me to be on call, and I won’t leave town or take an edible. Otherwise if you call me and I’m not picking up, it’s because I am unavailable.

Get hired somewhere else pronto, then don’t show up.

Bonus points if everyone quits at the same time.

Tracking who loses the “privilege” of their shift, then having to ask others to cover said shift, who may or may not be able to cover, then tracking these people further, and taking away the second wave of “disobedient slaves” shifts next week…. brilliant. You should nominate her for a Nobel prize.

Depending on where you live this manager’s behavior may be illegal. I’d consult a labor lawyer and your local labor authorities and document any and all communication!

HR advice:
Take a photo and send it to your HR team/ corporate, and let them know that your manager is requiring people to be on call for shifts and ask if there will be a shift differential moving forward to support this. You can also let them know that your manager is retaliating against people who are not on call.

Never pick up the phone on your free time.

If you want me to be available to take your calls 24/7, you pay me to be on call 24/7.

Since you don’t, that’s a “you” problem.

I bet the manager has different feelings about employees taking time off to recover.

Depending where you live this may be highly illegal, and she even did you the courtesy of writing down her crime and displaying it in public.

I’d consult a lawyer and potentially leave even if there was no legal case. And I would call her boss or bosses to let them know that I was very sad to leave but could not continue to work under threat of financial instability. And that they might want to look into it as I heard several people discussing the exact same thing.

But if YOUR arm was in a cast, watch how the expectations reverse.

Great that she put it in writing. By specifying that you are required to report to work when asked with no notice, you are on-call, or what in labor law is known as โ€œengaged to wait.โ€ In most states, that means they have to pay you. So my malicious compliance here would be to file an unpaid wages complaint with your stateโ€™s department of labor. Calculate how many hours a day your store is staffed (ex store open from 10am to 8pm with an hour pre-open and an hour post close, 12 hours a day) multiply by number of days since Captain dipshit posted this notice, and file your wage claim based on that.

I would also call corporate HR and let them know that your manager has posted this policy and you intend to file an unpaid wages complaint.

I guarantee she wouldn’t give anyone else the same grace if they were in her position, with having a bum arm/leg/etc. People like this only ever consider themselves, their needs and convenience.

You need to learn your rights as an employee. This could be illegal depending on where you live.ย 

Document everything this manager says in writing.

If you are in the US AND live in a one-party state, you can and should secretly record any in-person communication with this abusive manager and keep it in case it is important.
